• Party to appeal judgement
A suit filed by the All Progressive Congress (APC) challenging the composition of the Ekiti State Electoral Commission (EKSIEC) has been dismissed by a high court sitting in Ado Ekiti for lack of merit.
The judgement may have cleared way for the local council polls scheduled to hold on Saturday.
But the party in its quick reaction said it would appeal the judgment.
The APC had gone to court to challenge the composition of the 7-member EKSIEC, saying all of them including its chairman Justice Kayode Bamisile (rtd) were card carrying members of the Peoples Democratic Party (PDP).
Justice Dele Omotosho who presided over the case held that the plaintiff failed to proof that EKSIEC members were members of a political party failed to proof its case.
He added that the plaintiff sought for relief on its purported claims that the constitution of the EKSIEC by the state governor was unconstitutional and that the EKSIEC members were card-carrying members of the PDP.
He said that the allegations were spurious because the plaintiff’s counsel missed the points through his argument. “The court cannot turn itself to an investigator,” Justice Omotosho said.
However, the APC has said that the judgement has further confirmed that Ekiti State Judiciary is in chains of Governor Ayodele Fayose’s brutality and dictatorship.
