The All Progressives Congress (APC) in Ekiti State has again petitioned the Attorney General and Minister of Justice of the Federation, Abubakar Malami, urging him to prosecute suspects in the alleged June 21, 2014 governorship election fraud in the State as captured in an audio tape secretly recorded by Captain Sagir Koli.

It said the latest petition was informed by failure of the Office of the Minister of Justice to act on its earlier petition of February 13, 2015 demanding probe into the audio tape detailing acts of treason by some political leaders in cahoots with some military officers to cause a change of government in the State through means other than as prescribed by the 1999 Constitution of Nigeria.

In the February 13, 2015 letter to the office of the former Minister of Justice, Mohammed Adoke, and copied to former Inspector General of Police, Suleiman Abba; and Independent National Electoral Commission (INEC), the party prayed them to prosecute persons involved in conspiring and perpetrating acts to unseat former Governor Kayode Fayemi in a manner other than that envisaged by the Constitution.

In the fresh petition by the State Chairman of APC, Olajide Awe, the party said the reminder to the Attorney General of the Federation (AGF) became imperative in light of the action taken by the Military to investigate the culpability or otherwise of their men and officers.

He added that although it was not clear whether the Military took its action unilaterally or at the prompting of the AGF, it is now imperative that other security institutions accused of complicity in this treasonable action should also be compelled to institute investigations into the roles of their officers and men in the Ekiti electoral fiasco.

In Awe’s earlier petition, APC called AGF’s attention to an audio recording by Captain Sagir Koli of the 32 Artillery Brigade based in Akure which was released to the public capturing the voices of some top officials of immediate past Goodluck Jonathan government, political leaders and a top military officer where they strategized on the June 21, 2014 governorship election

APC asked INEC to investigate the matter and prosecute its staff involved to bring them to justice for offences against the Electoral Act. It also asked the police authorities to investigate their personnel for the act of undue influence, conspiracy, treason and breaching the provisions of the Nigerian Constitution and Criminal Code in the prosecution of Ekiti election in favour of the PDP’s candidate.

Awe pointed out that the import of the audio tape was the revelation of the criminal acts that were planned and perpetrated by these men, stressing that the act contravened Section 1(2) of the 1999 Constitution as amended.
According to him,  Section 1(2) ‎says “The Federal Republic of Nigeria shall not be governed, nor shall any person or group of persons take control of the Government of Nigeria or any part thereof, except in accordance with the provisions of this Constitution.”
